• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service

• Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful

3. Accounts and Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account

4. Business Data and Intellectual Property

Your Data: You retain all rights to the business data you upload to the Service. You grant us a limited license to use, store, and process your data solely to provide the Service to you.

Our Platform: The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Emajinet and are protected by copyright, trademark, and other intellectual property laws.

5. Subscription and Payment

Some aspects of the Service are provided on a subscription basis. You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

5.1. Refund Policy

30-Day Money-Back Guarantee: We offer a 30-day money-back guarantee for first-time subscriptions only. If you are not satisfied with Emajinet within the first 30 days of your initial subscription, you may request a full refund of your subscription fee.

Refund Eligibility: To be eligible for a refund:

• You must be a first-time subscriber (not a returning customer)
• Your refund request must be made within 30 days of your initial subscription date
• You must not have violated these Terms of Service or engaged in any fraudulent activity

Non-Refundable Items: The following are not eligible for refunds:

• Subscriptions renewed after the initial 30-day period
• Usage fees, transaction fees, or other service charges
• Subscriptions terminated due to Terms of Service violations
• Refunds requested after 30 days from the initial subscription date

How to Request a Refund: To request a refund, please contact us at support@emajinet.africa with your account details and reason for the refund request. Refunds will be processed within 5-10 business days to your original payment method.

6. Multi-Tenant Environment

Our Service operates in a multi-tenant environment. Your business data is logically separated from other businesses. You are responsible for managing access to your business data within your organization.

7. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMAJINET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Emajinet operates, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the new Terms.
